CLEAR Solutions, Inc. (“CLEAR Solutions“) welcomes you to this website (“Website“). The Terms and Conditions (“Terms“) appearing below govern the sale of goods and/or services sold or supplied by CLEAR Solutions and its affiliates.

Acceptance


By using the Website and the services it offers, you are agreeing to these Terms. Please be sure to read the Terms carefully and check back regularly as the Terms are subject to change at any time.

Even if these Terms do not accompany every product sold by CLEAR Solutions, these Terms shall govern all sales made by CLEAR Solutions until such time as new Terms and Conditions are provided to you by CLEAR Solutions.

All content displayed on the Website or otherwise provided by CLEAR Solutions through any other form of electronic communication is the sole property of CLEAR Solutions and/or its affiliates. This content includes but is not limited to images, graphics, icons, logos, text, articles, test data, product literature, standard operating procedures, documents, and interactive tools.

This content is the exclusive property of CLEAR Solutions and/or its affiliates and is protected by United States as well as international copyright laws. The use of this content without the express, written permission of CLEAR Solutions is prohibited.

Limitation of Liability


CLEAR Solutions is not liable for consequential damages. No claims made whether as to delivered goods or for the non-delivery of goods shall be greater than the price of those goods at the time of purchase.

Access to the Website


CLEAR Solutions works hard to ensure the Website is always up and available to the public, but CLEAR Solutions does not guarantee that the Website will not have downtime for any reason. CLEAR Solutions reserves the right to close all or portions of the Website for short periods of time for general maintenance but will attempt to keep this to a minimum.

An account is required to access certain parts of the Website and to participate in certain services provided by CLEAR Solutions. When you register an account on the Website, you are required to create a secure password. It is your responsibility to ensure that all information you enter on the Website is correct and to keep your login credentials and information private.

CLEAR Solutions reserves the right to disable your account at any time or for any reason, including if, in CLEAR Solutions’ opinion, you have failed to comply with any provision of these Terms.

Prices


Products sold and/or advertised on the Website are offered at wholesale price only. For special pricing, volume discounts or other agreements, please contact CLEAR Solutions by phone (949) 429-8922 or email (info@clearsolutionscorp.com).

Product prices do not include any applicable sales tax or shipping charges and are subject to change at any time without notice. Applicable sales tax as well as shipping charges are calculated on the Cart and Checkout pages and are calculated based on the shipping address you enter.

Shipping charges are not displayed for “LTL Freight Only” items as freight for these items must be arranged and scheduled after purchase of the item. Shipping charges for “LTL Freight Only” items are billed separately at the time of shipment.

Description of Goods


CLEAR Solutions will endeavor to be as accurate as possible when describing a product but does not guarantee or warrant that product descriptions or images are without error or up to date. We rely on our suppliers to provide us with the most updated information regarding their products but cannot guarantee that the information displayed regarding these products is entirely up to date.

If you discover that a product advertised or sold on the Website is not as described, you must notify us and return the product in unused condition.

Availability


CLEAR Solutions attempts to ensure that information regarding stock and availability of all products sold on the Website is accurate and current but does not guarantee that this will always be the case. If at the time of order a product was erroneously marked as “In Stock”, an employee of CLEAR Solutions will contact you to inform you of the error and will give you the option to either refund the backordered product or wait until new stock arrives.

Product that is out of stock is considered to be “Backordered” and will display as such when added to your cart/order. This information is prominently displayed on each product page and a note will appear on the Cart and Checkout pages whenever your cart/order contains backordered items.

If you place an order containing backordered product, CLEAR Solutions will ship out the available products first and follow with outstanding items once additional stock has arrived. You will be notified via email when this occurs.

Products that are marked as “Backordered” will have an estimated lead time displayed. This is the projected amount of time that it will take for new stock to arrive for that product. Though CLEAR Solutions endeavors to fulfill backorders within this timeframe, CLEAR Solutions does not guarantee that these lead times will be entirely accurate as it does not have control over issues due to freight or supplier fulfillment.

If at any time a product should become unavailable after your order has been confirmed and paid for, CLEAR Solutions will refund the full price paid for said product (including shipping and tax) within thirty (30) days following the date of received payment.

Shipping and Delivery


CLEAR Solutions will attempt to ship all orders placed before 3:00 PM (PST) on the same day the order was placed. CLEAR Solutions does not guarantee that all orders will ship same day in the event of unforeseen consequences such as technical or logistical issues. Same day shipping is not guaranteed on holidays, weekends, or days that CLEAR Solutions is closed.

All parcel shipments will be processed by UPS using the shipping method you provide at the time of your order. Please note that the estimated delivery dates displayed in the shipping options of the Cart and Checkout pages are estimates only and CLEAR Solutions does not guarantee that these delivery dates will be accurate in the event of issues during transit with UPS.

You will receive an email when your order partially/fully ships. This email will contain the tracking number with a link to the UPS Tracking page as well as a list of items included in the shipment.

Products marked as “LTL Freight Only” cannot be shipped via standard parcel shipping and must be shipped using an LTL freight carrier. CLEAR Solutions will contact you after an order is placed containing LTL Freight Only items to schedule a pickup with one of CLEAR Solutions’ LTL carriers.

Any damages or shortages must be reported within three (3) days of receipt of product. In the event that this occurs, you may contact CLEAR Solutions directly by email (info@clearsolutionscorp.com).

Force Majeure


CLEAR Solutions will not be held liable for any delays in the delivery of orders, due in whole or in part, directly or indirectly, to fire, act of God, strike, shortage of raw materials, retooling, upgrading of technology, delays of carriers, embargo, government order or directive, plague or pandemic, or any other circumstance beyond CLEAR Solutions’ reasonable control.

Indemnification


You shall indemnify and hold harmless CLEAR Solutions its affiliates, directors, officers, agents and employees from all loses, claims, damages, expenses or liabilities of any kind (including attorney’s fees and court costs) resulting from or arising out of any use by you of the products purchased herein.

You shall protect and indemnify CLEAR Solutions and its affiliates, directors, officers, agents and employees against all claims for damages or profits, including all reasonable costs incurred by CLEAR Solutions in connection therewith, arising from infringement of patents, copyrights, trademarks or misappropriation of designs, proprietary data or trade secrets of any person with respect to all goods manufactured either in whole or in part in accordance with your specification.

Return of Goods


CLEAR Solutions accepts returns of purchased items within thirty (30) days of the date or original purchase. All returned goods must be in original, unaltered condition and are subject to inspection for approval by CLEAR Solutions prior to the processing of any refunds.

If you need to return a product you’ve purchased from CLEAR Solutions or from an order made on the Website, you must contact CLEAR Solutions by phone or email. A member of CLEAR Solutions will contact you regarding the return and will send you a Returned Goods Authorization (RGA) form. Returns are not valid unless expressly authorized by CLEAR Solutions and accompanied by a completed RGA form.

Approved returns will be refunded to the original credit card used to place the order, subject to service handling fees and a 20% restocking fee.

Transportation of returned goods is to be arranged and paid for by you, unless otherwise specified and authorized by CLEAR Solutions.

Upon receipt of approved, returned goods, CLEAR Solutions will inspect the return to ensure all requirements are met and that the product is in acceptable condition. Any returns received without the required RGA form will be rejected. CLEAR Solutions may, in its sole discretion, either (a) credit you the amount paid for the returned goods, (b) repair the returned items, or (c) replace one or all returned items within a reasonable time after CLEAR Solutions determines that the returned goods are not in accordance herewith. CLEAR Solutions will not be held liable for any damages arising from the defective delivery or delay caused thereby.

Arbitration


Any and all disputes or controversies arising under, out of or in connection with these Terms or the sale or performance of the products shall be resolved by final and binding arbitration in the State of California.

Cancellation


CLEAR Solutions will not accept cancellations of orders that have already shipped.

Back Charges


Under no circumstances shall CLEAR Solutions be held liable for or accept any back charges.

Updates to the Terms


CLEAR Solutions reserves the right to update these Terms at its discretion without any notice. It is your responsibility to keep up to date with the latest changes to these Terms by checking this page on a regular basis. When changes are made, the “Last Updated” date at the top of this page will be updated accordingly.
